Outbound AI Calling and Consent: The Basics
Outbound AI calling can be a useful way to follow up with people who expect to hear from you. It also comes with real legal responsibilities. In the United States, calls made with artificial or prerecorded voices are covered by the Telephone Consumer Protection Act (TCPA) and by state laws, and the rules can be strict.
Start with consent
The safest outbound campaigns call people who clearly asked to be contacted, for example someone who requested a quote and gave you their number for that purpose. The type of consent required can depend on the kind of call, whether it is marketing, and the type of phone line, so get advice on what applies to you and keep records of how each contact gave permission.
Honor opt-outs right away
If someone asks not to be called again, stop. Keep an internal do-not-call list, remove people promptly, and make sure your agent's script tells people how to opt out. Check national and state do-not-call registries where they apply.
Call at reasonable times
Many rules limit the hours when calls can be made, based on the recipient's local time. Schedule campaigns within permitted hours and be careful with contact lists that span time zones.
Be clear and honest
- Have the agent identify your business and say it is an AI assistant
- Explain why you are calling
- Never mislead people about who is calling or why
- Use phone numbers you are allowed to use
Your responsibilities with Infinite AI Calls
Our Terms of Service (section 9) require that you only call people you have the right to call, get any consent the law requires, honor opt-outs and do-not-call requests, and follow calling laws. The platform gives you the tools; how you use them is up to you.
Keep good records
If anyone ever questions a call, records help. For each contact, keep where their number came from, when and how they agreed to be contacted, and when they asked to stop. Keep your campaign scripts too, so you can show what callers heard.
Questions to ask your lawyer
- What kind of consent do I need for the calls I plan to make?
- Are any of my contacts on mobile phones, and does that change the rules?
- Which state laws apply to my contact list?
- What must my agent say at the start and end of each call?
Used responsibly, outbound campaigns are a respectful way to follow up with people who are waiting to hear from you. See Using Calling Campaigns to Follow Up With Leads.
